This service agreement shows that EBC is transparent about everything it does. Even though this is a lengthy document, it clearly states all terms and conditions for taking an EBC TEFL course. I understand that this is a service agreement between EBC Servicios Linguisticos Europe SL., (located in Madrid, Spain) herein referred to as “EBC” and myself, the applicant. This service agreement is subject to the laws of the Kingdom of Spain.

COVID

EBC adheres to a strict COVID protocol for the safety of everyone participating in an EBC TEFL course. However, I acknowledge that EBC cannot be held accountable if I contract COVID during the course.

Application

Application information

I hereby state that the personal information I have provided on the EBC course application form is true and accurate and does not misrepresent me in any way to EBC. I also state that the written material in answer to the essay questions required for acceptance onto the EBC TEFL course is my work. I have disclosed the true disposition of any past, pending, or potential future criminal proceedings. I have stated all medical conditions that could affect the other course students or my regularly attending the course on my application form. Failure to declare such medical conditions could result in EBC withdrawing my offer of acceptance. Should EBC withdraw the offer of acceptance, any money I have already given to EBC will be subject to the Cancellation clause as set out in this agreement. Once I have started the course in any EBC location, if I am forced to terminate the course for reasons relating to an undeclared criminal or medical issue, I will be disqualified from using any part of the Cancellation Clause. I acknowledge that I have read, understand and agree to the entry requirements for my chosen course and that I will be asked to present documentary supporting evidence when and where required by EBC.

Emergency contact information

I will give EBC emergency contact information for someone who will advise EBC what to do for me in an emergency or situation where I cannot act on my behalf. I swear that the person I name has agreed to act in the capacity of emergency contact and that the details I have given are accurate. If it is necessary for an EBC representative to use the emergency contact, I authorise EBC to freely communicate with the emergency contact person. I understand that if the contact details I give are false or inaccurate, EBC will be limited in its ability to assist me should an emergency arise.

Course

Application acceptance

I UNDERSTAND THAT IF I AM ACCEPTED ONTO THE COURSE, I WILL INITIALLY RECEIVE (VIA EMAIL) a letter of acceptance informing me that I have been accepted to attend an EBC course on a specific date. However, I understand that application acceptance is not guaranteeing my course place.

Course place reservation

My place on a particular course date and location will be guaranteed once I have paid EBC a non-refundable deposit or paid for the course in full.

Final fee payment

I understand that I must ensure that EBC has received the final course fee balance at least one calendar month before the course starts to maintain my course place guarantee. If I fail to pay the course fee balance at least one calendar month before the course start date, I understand that EBC reserves the right to move me to the next available course start date.

Course requirements

Submitting a falsified application may be judged as grounds for:

  • Immediate withdrawal of my acceptance offer;
  • Ineligibility for a future EBC course;
  • Dismissal from a current course in which I am enrolled.

I agree to attend every class and any other course-related meetings and be present at the designated course start time. I acknowledge that habitual lateness or being absent without good cause is grounds for dismissal from the course. Should EBC find it necessary to dismiss me from the TEFL course, any monies paid to EBC will be subject to the Cancellation clause as set out in this agreement. If I am absent, and depending on the cause of absence, it may be possible to make up the work I have missed at the discretion of the EBC course manager. I acknowledge that unprofessional, disruptive, or offensive behaviour is grounds for immediate course dismissal. Should this happen, I will forfeit all monies already paid to EBC. I understand that I must successfully complete all course components within the course period to pass the course. If I do not pass the EBC course, I understand it may be possible to retake course components at the discretion of the EBC Staff; however, additional fees may apply.

Personal conduct

During the course, I will behave courteously and professionally to all persons associated with the course, whether they be representatives of EBC or other third parties associated with the course. I acknowledge that unprofessional, disruptive, or offensive behaviour is grounds for immediate course dismissal. Should this happen, I will forfeit all monies already paid to EBC.

Passing the course

I acknowledge that I can fail the EBC course if I do not perform to the required standard. I also understand that an official examination board externally moderates the EBC course. Therefore, if my work is of insufficient standard, I will not be put forward to Trinity College for final assessment. However, if any of my work is below standard, I accept that EBC will ask me to correct/upgrade my work to fulfil the course requirements.

Accommodation

I agree that EBC is not responsible for any aspect of any accommodation that I arrange. If I select any accommodation from the providers listed on the EBC website or from any other source, then I acknowledge that I have no recourse against EBC concerning location, quality, cost, or any other aspect with which I am not satisfied. EBC is not liable for any loss, damage, or injury to persons or property that may occur at any accommodation arranged through EBC or otherwise.

Liability waiver

I acknowledge that EBC is not responsible for:

  • my health, safety, and welfare;
  • any loss, theft or damage to my personal property.
CertPT certificate processing

I understand that because of Trinity College London limitations, EBC will file my work for my CertPT certification when EBC reaches the Trinity required minimum of 5 submissions or quarterly (every three months), whichever happens first. I acknowledge that the quarterly submission dates are the first working day of January, April, July and October.

Health and safety

Health and medical and insurance

I will take out health and travel insurance at my expense that will provide all coverage required in the event of illness, accident, or death. I will ensure that the insurance I take out will cover me against all medical expenses (including emergency evacuation) all costs for making necessary arrangements in the case of my death. I also agree to purchase supplementary insurance on my own, as may be required to secure my entry, extended stay, and general well-being or as required by the country’s law in which I will reside. EBC is not responsible for: any aspect of my health, injury or death at any time before, during, or after completion of the course. Should I choose to take out insurance from one of the insurers on the EBC list or any other insurers, I will not hold EBC responsible for any business transactions, the consequences of any business transactions or correspondence I undertake with these insurers.

Personal safety

EBC is not responsible or liable for my safety or any information provided to me regarding the safety of any country or region throughout the world. Furthermore, at no time shall I hold EBC responsible or liable for suggestions made or information provided about the safety of a particular country or region of the world.

Travel and jobs

Travel arrangements

I acknowledge that I am entirely responsible for arranging my travel and that EBC is not responsible for any aspect of the travel arrangements I make. EBC is not responsible for: any aspect of my health, injury or death at any time before, during, or after travelling to or from the course. Should I choose to use one of the travel services on the EBC list or any other travel service, I will not hold EBC responsible for any business transactions, the consequences of any business transactions or correspondence I undertake with the aforementioned travel services.

Entry visas and work permits

I am responsible for obtaining an appropriate visa, where required before I enter the country of my chosen course location. If I must obtain a visa, I shall contact the relevant embassy or consulate for the visa conditions and obtain an appropriate visa before my entry. I understand that getting a visa or work permit is my responsibility. EBC cannot be held liable for my failure to secure any type of visa or permit. Should I fail to attend the course because of visa problems or the lack of required documentation for entry into the country where my chosen training centre location is, any monies I have already given to EBC will be subject to the Cancellation clause as set out in this agreement.

Job placement assistance

I understand that EBC does not guarantee jobs and is not a job agency but does offer job guidance and assistance to all successful graduates. EBC will provide me with job advice, interview training and assist me in looking for a job when I request it. I agree to present myself professionally and courteously in line with local cultural expectations and academic standards when attending job interviews.

I understand that I am responsible for attending and passing job interviews and making work arrangements with language schools. The language school makes the final decision about hiring you. EBC has no influence over language school hiring practices and accepts no responsibility for any consequences arising from a job or failing to get a job.

If I experience difficulty finding a job teaching English, EBC, when and where possible, will provide further assistance and advice. If necessary, EBC will allow me to retake relevant components of the EBC course (additional costs may apply), which will help me get a TEFL position. I understand that EBC reserves the right to refuse job placement assistance for working in countries that EBC considers dangerous. I fully understand that my success in obtaining work through the EBC job placement assistance programme may be limited if I am younger than 21 years old and I do not have a degree.

Cancellations, refunds and payments

Cancellations and refunds for courses

I understand that the Trinity College CertTSOL fees are not refundable under any circumstances. If I cancel before my first scheduled course start date, I will be entitled to a one-time reschedule for a future course in the same centre. If I cancel and reschedule again, I understand that I will need to pay the difference between what I have paid and the new course fee if the course fee changes. Once I have started an EBC course, and due to a “force majeure” – unforeseen circumstances – (for example, but not limited to a family death, natural disasters like fire, flood, or homelessness), I am forced to terminate the course before it ends I will be entitled to a one time reschedule to a future EBC course. If I cancel and reschedule more than once, I will have to pay an additional course deposit every time I cancel and reschedule for a future course.

You must reschedule and start your course within six months of cancelling your initial course, or you will lose your fees.

If I cancel a Road2Spain package, which includes the CertTESOL or CertPT course + 1-year student Visa + 1-year Spanish programme, I cannot get the same programme price if I decide to enrol again.

Student Visa Refund

If my student visa application is rejected by the Spanish/French/Italian Consulate or Embassy, I must send EBC and the Spanish language school a copy of the rejection letter. This letter must be an official rejection letter from the corresponding consulate stating why the student visa was denied. The refund amount is calculated as follows:

  • the cost of the programme – the cost of the Trinity course – a 20% Spanish school and EBC combined admin fee = refund amount

Here is a sample:

  • Road2Spain total fee – CertTESOL course fee = Spanish course refund before School and EBC admin fees
  • Spanish course refund before School and EBC admin fees – 20% admin fee = Total refund after admin fees

Refunds will only be paid to PayPal or Wise accounts.

Spanish language course refund

Once your invitation letter has been issued by the language school, cancellations of the language programme are non-refundable unless your student visa application is rejected, as detailed in the “Student Visa Refund” section.

Cancellations and refunds for accommodation

I understand that the accommodation fee is non-refundable, and rescheduling is not allowed.

Payments

I guarantee that all payments made are taken from my funds. If for whatever reason, a third party pays for my fees for the EBC course on my behalf, I confirm that the third party has agreed to such payment. I understand that I am responsible for all damages, bank fees, credit card fees, or penalties that may be associated with the un-authorised use, transfer, or disclosure of credit or bank account information (for example, but not limited to: any bank charges, disputes, reversals, refunds, legal fees, court fees, or any other fees, expenses or penalties). I agree that I am responsible for paying all bank fees, charges, and associated costs when making payments to EBC.

Buying a Trinity CertTESOL or Trinity CertPT course place from another student

If I buy an EBC Trinity CertTESOL or Trinity CertPT course place from a previously enrolled student through a private agreement, I acknowledge that I am limited to taking the course in the location that the student was enrolled in. For example, if a course place is bought through a private agreement from a student enrolled in Madrid, the course can ONLY be taken in Madrid. It cannot be resold again and cannot be transferred to another location. EBC does not get involved with private sale agreements but will endorse them if the buyer asks for proof authenticating the sale. Fees for all other courses, accommodation, the one-year Spanish student visa and the one-year Spanish course at a Cervantes Institute school CANNOT be transferred.

Discounts and special offer fees

EBC offers discounts or special fees for selected courses from time to time. These fees are of fixed duration and ONLY apply to the course that was paid for on a special offer. If I choose to transfer to a different course, I acknowledge that I will have to pay the difference between the special offer fee and the fee for the course I want to transfer to. Like all companies, EBC has special offer fees for a limited time only. If I enrolled for a course before the offer started or after it finished, I acknowledge that I am not entitled to any refund. If I am referred by someone and then take advantage of a special offer fee course or a course fee discount, I acknowledge that the person referring me cannot collect their referral fee. Discounts are only given to students that apply and enrol directly through EBC.

Correspondence

Email

I acknowledge that all official correspondence shall be conducted via email. I understand that if I want to change any arrangement with EBC (reschedule, change, cancellation etc.) I must do so via email. Should my email address or pertinent contact information change, I shall notify EBC within a reasonable amount of time. I understand that it is my sole responsibility or the responsibility of my authorised representative to check for all continuous email correspondence from an authorised EBC representative. I understand that when EBC is reaching the maximum number, it is allowed to accept on my chosen course; I will receive a courtesy email if I am not fully paid. I understand that the purpose of this email is to guarantee my course start date if my course is oversubscribed. Although my deposit guarantees me a place on the course of my choice, the EBC Service Agreement also states that EBC reserves the right to move me to another course date if payment is not received at least 30 days before the start date or if EBC is reaching the maximum number allowed and other students are willing to pay in full to get the last remaining spots. I understand that I may delay my final payment until 30 days before my course start date, but if there are no more places left at that time, I acknowledge that EBC will move me to another course start date.

Delivery by post, courier, hand delivery or personal pick-up from EBC

I understand that it is my responsibility to ensure that I give the correct delivery details (my name, my address, my apartment number, etc.) to EBC to deliver any correspondence that requires any type of mail, courier or hand delivery service. It is also my responsibility to regularly check with the place I live to see if the EBC delivery has arrived. I understand that EBC is not responsible for any lost, misplaced or damaged correspondence (including my TEFL / TESOL / Trinity certificate) sent to the address I gave to EBC, and I understand that EBC will not pay for any additional costs for replacing and resending what EBC originally sent to me.

EBC will send your Trinity College certificate by ordinary post. If you want your Trinity College sent by any other means, you will pay all delivery charges before your Trinity College certificate is sent to you. EBC will send you proof of the delivery cost before making the payment.

Training programme changes

Training programme information

I understand that the information contained in all EBC literature, including the EBC website, emails, printed material etc., is believed to be accurate. However, I understand that it may be subject to errors, changes, omissions, course availability, or special offers withdrawal without notice. Therefore, it is the responsibility of the applicant to contact an official EBC representative for periodic updates as the terms of the EBC training programme offers are subject to change without notice.

Training programme delivery

I understand that if circumstances dictate, EBC has the right to move me from an onsite delivered course to an online given course that awards the same certification.

I understand that if the recommended minimum Trinity College group size of six students is not met, EBC has the right to move me to a future course with more students.

End of course survey

I will be asked to complete a student survey form at the end of the course. I allow EBC to use all of the information I write on the student survey form in its promotional literature regardless of media type (e.g. web, print, TV, radio etc.) and as a source of ideas for making changes to any aspect of the course.

Course changes, service changes and fee changes

I understand that to improve the quality and content of the course, EBC reserves the right to change any aspect of the training programme, associated services and course fees without notice. I also understand that EBC has the right to correct errors relating to all written material that refers to services offered and prices.

Accommodation acceptance conditions

I acknowledge and agree to the following terms and conditions:

  • EBC provides this service to help me get reliable accommodation without the additional cost of a middle-man.
  • EBC is not responsible for any aspect of any accommodation arranged using these or other services.
  • The accommodation fee is not refundable, and only for documented reasons relating to personal safety will EBC assist me in finding alternate accommodations. If EBC has to find me alternative accommodation, I agree to pay any additional costs required to get the alternative accommodation.
  • I understand that there is no guarantee that EBC will find alternate accommodations within the four week time I have paid for.
  • I understand that all prices are subject to change without notice.
  • I understand that it is my responsibility to ensure that I am fully aware of all fees, deposits, payment terms etc., before using this accommodation service.

Terms and conditions for the Road2Spain Spanish programme and student visa

I understand that if the Spanish language school increases its prices, I will be subject to its payment policy regarding any possible additional payment.

EBC is not responsible for the consequences if the Spanish language schools change prices, terms and conditions or closes, cancels or withdraws their Spanish programme.

EBC, in collaboration with each Spanish language school, will not issue the invitation letter allowing me to apply for a student visa until I have paid in full for the one-year Road2Spain Spanish language programme.

EBC will refund 50% of the Road2Spain fee if I cancel before the student visa documents have been sent to me.

EBC will not refund the Road2Spain fee if I discontinue the student visa process any time after the student visa documents have been sent to me.

I understand that if I qualify for a refund, the refunded amount will be what I paid minus the administration fee as dictated by the corresponding Spanish school.

I understand that I will not get a refund if any problems arise after my student visa has been granted.

I understand that the definition of Student Visa ONLY covers issuing my initial Student Visa. There are no refunds for the Student Visa extension procedure, application for a part-time work permit under Article 90 of the current student visa legislation, or any subsequent Student Visa renewals.

I understand that the tuition fee for the Trinity CertTESOL and CertPT courses that may be a part of my Spanish and Student Visa programme is not refundable.

I understand that I will get a refund subject to the following terms and conditions:

  • I am cancelling my Spanish and Student Visa programme.
  • If I apply for my student visa and am rejected, I send EBC and the corresponding Spanish school the original copy of the Consulate’s or Embassy’s rejection letter.
  • If I fail to get a student visa, I must inform EBC within seven days of my rejection. In addition, I understand that I must mail the original rejection letter to EBC and the corresponding Spanish school.

EBC has no control over any paperwork associated with job offers, the amount of time it takes the Spanish government to process the paperwork or the final decision of the Spanish government regarding your student visa status and right to work. Therefore, EBC accepts no responsibility or liability if an employer refuses to complete any additional paperwork required to activate your student visa for work, the time it takes to process the job offer or the final decision of the Spanish government regarding your student visa status and right to work.

Restatement of employer intention

If you are offered and accept a job based on your EBC certificate and later your employer decides to change the rules surrounding the acceptability of the EBC certificate, EBC will not be held responsible for the consequences of the change. If your employer subsequently insists that you take another course, EBC will not be held responsible.

Service agreement acceptance

By completing the application process and submitting my application for the EBC course to EBC Servicios Linguisticos Europe SL, I hereby state that I agree to be bound by the content of this EBC Service Agreement.
